Most MUSA MISTRAL products featured on the Site are available in select MUSA MISTRAL stores, while supplies last. In some cases, items sold on the Site may not be available in MUSA MISTRAL stores.

The prices appearing on the Site are indicated in Mexican pesos, including VAT, and are valid and effective only in Mexico.

We have tried to represent the colors of our products that appear on the Site as accurately as possible. However, because the colors you see depend on your monitor, we cannot guarantee the accuracy of the colors that appear on your screen.

CANCELLATION POLICY


RIGHT OF CANCELLATION



You may cancel your contract in writing (e.g., by letter, fax, or email) within two weeks without giving any reasons for cancellation, or, if the item was shipped before the expiration of this period, by returning the item. The period begins upon receipt of this written declaration, but not before the recipient receives the goods (in the case of multiple deliveries of the same type of goods, the cancellation period begins until the recipient receives the first consignment) and not before we have fulfilled our duty to provide information in accordance with applicable law. CONSEQUENCES OF CANCELLATION


In the event of a successful cancellation, the services received by both parties will be returned, and any benefits derived (e.g., interest) from these services will be reimbursed. If you are unable to return the services provided and the benefits (e.g., benefits from their use) in whole or in part, or if you can only return them in poor condition, you must compensate MUSA MISTRAL for their value. You must only compensate MUSA MISTRAL for the value of the product's deterioration and for the benefits derived if the deterioration is due to handling of the item that passes the test of the item's characteristics and functional reliability. "Testing of the characteristics and functional reliability" means testing and evaluating the item in question, to the extent possible and in accordance with normal store usage. Obligations to reimburse payments must be fulfilled within 30 days. For you, the period begins when you send the cancellation declaration or the goods; for us, the period begins when we receive your declaration or the goods.

COMPENSATION


MUSA MISTRAL shall be fully liable for intentional and grossly negligent acts. In the event of slight negligence, MUSA MISTRAL's liability shall be limited to typical and foreseeable damages. The limitations or exclusions of liability under this clause shall not apply to claims based on product liability laws, nor to damages caused to life, body, or health, or if MUSA MISTRAL has provided a quality guarantee. If MUSA MISTRAL's liability is excluded or limited, such exclusion or limitation shall also apply to the personal liability of employees, representatives, or vicarious agents. The buyer shall indemnify MUSA MISTRAL, its employees, representatives, agents, and vicarious agents against any liability to third parties arising from any culpable breach of contract by the buyer. The buyer shall indemnify MUSA MISTRAL and the aforementioned persons for all necessary and reasonable defense costs.



SEVERAL


If any term or part of these General Conditions is or becomes invalid, this will not affect the validity of the remaining General Conditions. The invalid clause will be replaced by a valid one that most closely matches the spirit and purpose of the invalid clause. The same applies in the event of a legal loophole.
